She wasn\u2019t white. According to the NY Daily News, Ms. DaCosta reported that the bakery\u2019s co-owner told her &#8220;I can\u2019t hire you because you\u2019re black.&#8221; The bakery furthermore said that they would have hired her if there had been an opening in the kitchen where customers would not see her. As she left the interview, she was told to observe the pictures hanging on the walls. They were all white people.<\/p>\n<p>The New York City Human Rights Commission investigated the charges, including the owners\u2019 claims that Ms. DaCosta was lying and that the position had already been filled. Nevertheless, in a September 2013 decision, the Commission found the bakery\u2019s hiring practices to be discriminatory and ordered the bakery to pay:<\/p>\n<ul>\n<li>$10,000 in damages to Ms. DaCosta<\/li>\n<li>a $10,000 fine for <a href=\"https:\/\/discriminationandsexualharassmentlawyers.com\/employment-law\/race-discrimination\/new-york-city\/\">racial discrimination<\/a><\/li>\n<li>a $5,000 fine for <a href=\"https:\/\/discriminationandsexualharassmentlawyers.com\/employment-law\/gender-discrimination\/new-york-city\/\">gender discrimination<\/a> (for the gender-specific Craigslist ad seeking a \u201ccounter girl\u201d)<\/li>\n<\/ul>\n<p>Racial and gender discrimination in the workplace is illegal under federal law (<a href=\"http:\/\/www.eeoc.gov\/laws\/statutes\/titlevii.cfm\">Title VII of the Civil Rights<\/a> <a href=\"http:\/\/www.eeoc.gov\/laws\/statutes\/titlevii.cfm\">Act of 1964<\/a>), New York State law, and New York City law.
