In addition to enduring sexual harassment, Proulx alleged wage and hour violations for unpaid labor.<br \/>\n<img decoding=\"async\" class=\"wp-image-1940 alignleft\" src=\"\" alt=\"\u201cNew\" \/><br \/>\nThe sexual harassment lawsuit states Proulx was employed with Medina Golf Club for less than a year. During his time at the golf club, he alleged he experienced <a href=\"https:\/\/discriminationandsexualharassmentlawyers.com\/employment-law\/sexual-harassment\/unwanted-physical-contact\/\" target=\"_blank\" rel=\"noopener noreferrer\">unwanted physical contact<\/a> by the kitchen manager. Proulx claims the unwanted physical contact consisted of the kitchen manager rubbing his genitals against Proulx\u2019s body.<br \/>\n<a href=\"https:\/\/discriminationandsexualharassmentlawyers.com\/employment-law\/sexual-harassment\/same-sex\/\" target=\"_blank\" rel=\"noopener noreferrer\">Same sex sexual harassment<\/a> might not be as common as sexual harassment between two individuals of the opposite sex, but it is still illegal. Although Proulx\u2019s sexual preference have not been disclosed, a male manager allegedly touching a male employee could potentially send mixed signals to individuals who happen to witness the workplace misconduct. As a result of the manager\u2019s misbehavior, Proulx&#8217;s personal and professional life could be damaged.<br \/>\nProulx said he reported the <a href=\"https:\/\/discriminationandsexualharassmentlawyers.com\/employment-law\/new-york-city\/\" target=\"_blank\" rel=\"noopener noreferrer\">acoso sexual<\/a> to the executive manager, Chad Kestner, for three incidents that took place, and the executive manager allegedly ignored the report. Instead, he informed Proulx, \u201csome things in this industry you just have to deal with and work past.\u201d Surprisingly, reporting sexual harassment to upper management turned out to be a dead end for Proulx.<br \/>\nSexual harassment was only one of Proulx\u2019s work related issues. Proulx reported being over worked and underpaid along with many other hourly workers. Proulx claims his employer reduced their pay by 45 minutes daily for a lunch break the managers\u2019s fail to allow them to have. Although the kitchen could have been far too busy to take scheduled breaks, there\u2019s always a way to regulate the chaos. The employer could\u2019ve taken a different approach and compensated the employees for their time on the clock. As long as the employees were working, they should\u2019ve been paid according to their hourly rate. In the event that working through breaks exceeded forty hours a weeks, the employees should\u2019ve received time and one half of compensation according to the Fair Labor Standards Act.<br \/>\nProulx departed from Medina Golf Club last February under a mutual agreement with the golf club. According to the sexual harassment lawyer representing Proulx, \u201cHe had done the most he felt that he could do, by reporting it up the chain of command.\u201d The sexual harassment lawyer also stated, \u201cwhen you\u2019ve complained and you\u2019re forced to come back to work, that certainly affects somebody in a significant way.\u201d<\/p>\n<h2 style=\"text-align: justify;\">Medina Golf Club Responds<\/h2>\n<p>Presently, the managerial staff has not released a statement regarding the pending litigation. They also refrained from issuing a requested copy of Proulx\u2019s employment contact. The defendant\u2019s attorney denied the sexual harassment allegations on his client\u2019s behalf by informing the public that Medina Golf Club \u201cprohibits sexual harassment.\u201d The defendant\u2019s attorney also reiterated the golf club\u2019s instructions that require employees to report sexual harassment to the supervisor or manager on duty. As far as the work breaks are concerned, the golf club alleged that employee compensation is important to the company according to the golf club\u2019s written policy, and Proulx\u2019s wage and hour allegation do not correspond with his \u201cpay records.\u201d<br \/>\nThe golf club response to the sexual harassment lawsuit indicated Medina did not have enough evidence to confirm Proulx endured sexual harassment, the reports he claimed he filed, or the negligence on the executive manager\u2019s side.
