Despite this fact, there are a\u00a0 number of anti-discrimination laws that protect people from discrimination outside of the workplace. The New York State Human Rights Law (\u201cNYSHRL\u201d) and New York City Human Rights Law \u201cNYCHRL\u201d) both have provisions making it unlawful for \u201ca place of public accommodation\u201d to engage in discrimination on the basis of race, color, age, national origin, alienage or citizenship, gender, sexual orientation, or disability.\u00a0Discrimination in public accommodations is covered by most state and local laws.<\/p>\n<p><img decoding=\"async\" class=\"wp-image-4626 size-full aligncenter\" src=\"https:\/\/discriminationandsexualharassmentlawyers.com\/wp-content\/uploads\/2019\/04\/public-accommodation.jpg\" alt=\"Discrimination in Places of Public Accommodation: Are You Protected? Discrimination in Public Spaces\" width=\"816\" height=\"495\" \/><\/p>\n<p>The term \u201cpublic accommodation\u201d is defined differently under both laws.<\/p>\n<p><strong>Under the NYSHRL, a public accommodation is defined as any public or private establishment, including but not limited to:<\/strong><\/p>\n<ul>\n<li><strong>Inns, taverns, road houses, hotels, and motels;<\/strong><\/li>\n<li><strong>Restaurants and saloons;<\/strong><\/li>\n<li><strong>Any store or enclosure where spirituous or malt liquors are sold;<\/strong><\/li>\n<li><strong>Ice cream parlors and soda fountains;<\/strong><\/li>\n<li><strong>Clinics and hospitals;<\/strong><\/li>\n<li><strong>Bathhouses, swimming pools, and laundries;<\/strong><\/li>\n<li><strong>Barber shops and beauty salons;<\/strong><\/li>\n<li><strong>Theatres, motion picture houses, and music halls;<\/strong><\/li>\n<li><strong>Public halls, public rooms, public elevators, and any public areas or any building or structure.<\/strong><\/li>\n<\/ul>\n<p>The NYCHRL defines the term as any \u201cproviders, whether licensed or unlicensed, of goods, services, facilities, accommodations, advantages or privileges of any kind, and places, whether licensed or unlicensed, where goods, services, facilities, accommodations, advantages or privileges of any kind are extended offered, sold, or otherwise made available.\u201d The NYSHRL and the NYCHRL set forth a number of exceptions that describe what businesses are not considered places of public accommodation.
