During the job application process, federal and state anti-discrimination laws protect applicants\u2014like you\u2014 from discrimination.<\/p>\n<p>In particular, under Title VII of the Civil Rights Act of 1964 and other federal laws it is illegal for an employer to discriminate against applicants on the basis of race, color, religion, sex, national origin, age, disability, and genetic information. Moreover, under Equal Pay Act of 1963 employers must pay men and women unequally despite performing substantially similar work.<\/p>\n<p>These protections mean that the following types of application or interview questions are generally improper:<\/p>\n<ul>\n<li>\u201cHow long have you lived in the U.S.?\u201d<\/li>\n<li>\u201cWhere were you born?\u201d<\/li>\n<li>\u201cAre you a U.S. citizen?\u201d<\/li>\n<li>\u201cWhat is your native language?\u201d<\/li>\n<li>\u201cWho do you live with?\u201d<\/li>\n<li>\u201cWhat is your marital status\u201d<\/li>\n<li>\u201cDo you plan to have a family?\u201d<\/li>\n<li>\u201cWhat are the ages of your children?\u201d<\/li>\n<li>\u201cWho cares for your children?\u201d<\/li>\n<li>\u201cWho will care for your children when you are sick?\u201d<\/li>\n<li>\u201cAre you pregnant?\u201d<\/li>\n<li>\u201cAre you disabled?\u201d<\/li>\n<li>\u201cDo you have a disability?\u201d<\/li>\n<li>\u201cDo you have any genetic diseases?\u201d<\/li>\n<li>\u201cHow old are you?\u201d<\/li>\n<li>\u201cWhat religious holidays do you observe?\u201d<\/li>\n<li>\u201cDoes your religion prevent you from working weekends?\u201d<\/li>\n<li>\u201cWhat is your religious affiliation or parish?\u201d<\/li>\n<li>Questions asked for the purpose of determining race, color, religion, sex, national origin, age, disability, or genetic information.<\/li>\n<li>Questions or comments about applicant\u2019s race or color concerning color of skin and complexion.<\/li>\n<\/ul>\n<p>Proper interview questions can be:<\/p>\n<ul>\n<li>\u201cAre you at least 18 years of age?\u201d<\/li>\n<li>\u201cWhen did you graduate from high school\/ college\/ grad school?\u201d<\/li>\n<li>\u201cDo you have a legal right to remain in the U.S.?\u201d<\/li>\n<li>\u201cWho referred you for a position here?\u201d<\/li>\n<li>\u201cWhat languages do you speak\/ understand\/ write with fluency?\u201d<\/li>\n<li>\u201cAre you able to work nights\/ weekends?\u201d<\/li>\n<li>\u201cOn occasion overtime work is required.
