Now the officers — Eddie Martins, 37, and Richard Hall, 33 of NYPD’s Brooklyn South narcotics unit — are facing 50 criminal charges each.
Prosecutors say, on September 15, 2017, Martin and Hall pulled over a car driven by an 18-year-old woman who was with two male passengers. The officers arrested the victim for drug possession and let the two male passengers go before driving off with the teen in the back of the van, then they took turns raping her in the back seat of their police van while she was still handcuffed.
Evidence against the men is extensive as DNA recovered from a rape-kit test on the victim matched samples taken from the men and surveillance footage showed the 18-year-old getting out of the police van about 40 minutes after she was stopped.
The victim soon filed a notice of claim against the New York City Police Department, Martins and Hall, their supervisor and the city of New York. The teen is seeking $50 million in damages.
New York City Police Commissioner James P. O’Neill said, “When a member of the NYPD is indicted on serious charges like these, it tarnishes all of the admirable things accomplished by other, good officers every day in neighborhoods across New York City. It also stains the legacies of those who paid the ultimate price in service to New Yorkers.”
As far Martin and Hall’s defense, they claim that the sexual encounter was not rape, but rather consensual sex in return for letting her go free. Moreover, they are attempting to blame the victim based on her clothing style and social media posts. These defenses are insulting.
It’s no secret that women are the majority of the victims of such crimes. Rape and sexual assault are horrible acts that no person should ever have to face, but if it does happen, victims are not alone. It is an uncomfortable conversation; however, victims of sexual harassment or assault are encouraged to seek help from an experienced sexual harassment lawyer and a counselor to cope with their tragedy. Conversing about one’s past will not reverse the devastating moment, but it could help release the anger and provide healing options an individual is an unaware of.
The Derek Smith Law Group, PLLC handles a multitude of cases that involve sexual harassment in New York City and Philadelphia. Call today to schedule a FREE sexual harassment legal advice Consultation in NY, NJ & PA with one of our top rated Philadelphia sexual harassment attorneys here at the Derek Smith Law Group you can reach us online or by calling 877-469-5297.
