{"id":2725,"date":"2017-09-18T10:03:37","date_gmt":"2017-09-18T14:03:37","guid":{"rendered":"https:\/\/discriminationandsexualharassmentlawyers.com\/?p=2725"},"modified":"2019-12-06T20:17:53","modified_gmt":"2019-12-06T20:17:53","slug":"estee-lauder-arent-dads-parents-too","status":"publish","type":"post","link":"https:\/\/dev.discriminationandsexualharassmentlawyers.com\/es\/estee-lauder-arent-dads-parents-too\/","title":{"rendered":"Est\u00e9e Lauder, Aren\u2019t Dads Parents too?"},"content":{"rendered":"<p>Est\u00e9e Lauder, Aren\u2019t Dads Parents too?<br \/>\n<strong>Philadelphia, PA <\/strong>&#8211; The male employees of the cosmetic giant Est\u00e9e Lauder have filed a claim with the <a href=\"https:\/\/discriminationandsexualharassmentlawyers.com\/employment-law\/eeoc-representation\/\">Equal Employment Opportunity Commission<\/a> (EEOC) alleging they were subject to unlawful sex discrimination. The men made the complaint because they feel they are entitled to the same amount of time off from work to bond with their newly born child as do women.<br \/>\nIn August, the EEOC filed the lawsuit in the U.S. District Court for the Eastern District of Pennsylvania on behalf of Christopher Sullivan, a father and Est\u00e9e Lauder employee who the company denied his requests for parental leave benefits because it went beyond what was allowed for fathers.<br \/>\nAllegedly, Est\u00e9e Lauder\u2019s current parental leave policy provides eligible new mothers six paid weeks for childbirth recovery and an additional six weeks off for paid parental leave for child bonding. However, that same policy only offers new fathers whose partners have given birth just two weeks of paid leave for child bonding.<br \/>\nOne EEOC spokesperson explained, \u201cIt is wonderful when employers provide paid parental leave and flexible work arrangements, but federal law requires <a href=\"\/es\/compensation-discrimination\/\">equal pay<\/a>, including benefits, for equal work, and that applies to men as well as women.\u201d Another EEOC Attorney added, \u201cAddressing sex-based pay discrimination, including in benefits such as paid leave, is a priority issue for the Commission.\u201d<br \/>\nOf course, men and women do have anatomical differences\u2014most importantly that women give birth and men do not\u2014thus policies involving such physical differences may be warranted under the law. While Est\u00e9e Lauder\u2019s gender-based post-childbirth leave based on the medical need to recover from childbirth is most likely lawful, because bonding is not necessarily based on anatomical differences and may be a form of <a href=\"https:\/\/discriminationandsexualharassmentlawyers.com\/employment-law\/gender-discrimination\/new-york-city\/\">gender discrimination<\/a>. Since it is based on an archaic view men\u2019s and women\u2019s roles in parenting, it will be difficult for such a policy based on bonding to fly with the EEOC or the courts.<br \/>\nWhat does this mean for you?
